These Terms of Service ("Terms") govern your access to and use of Oblivity, including any purchase, download, delivery, subscription (if applicable), custom development, configuration, consulting, support, and all related digital goods and services (collectively, the "Services").

By accessing our website, placing an order, submitting payment, or using any Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not purchase or use the Services.

Definitions

  • "Client", "you", "your": Any person or entity purchasing, accessing, or using the Services.
  • "Digital Goods": Any downloadable or electronically delivered files, code, scripts, configurations, templates, licenses, documentation, or similar content.
  • "Custom Work": Any tailored development, configuration, setup, integration, or consulting provided to you.
  • "Deliverables": The output of the Services, including Digital Goods and Custom Work.

Acceptance of Terms (Purchase = Agreement)

By completing a purchase or otherwise using the Services, you acknowledge and agree that:

  • You are entering a legally binding agreement with Oblivity.
  • You accept these Terms in full, including the No Refund Policy and Liability Disclaimer.
  • Any additional terms shown on the checkout page, invoice, product page, ticket, or written agreement may apply and form part of this agreement.

Orders, Scope of Work, and Delivery

4.1 Scope

The scope of each order is limited to what is explicitly stated in the product listing, invoice, order confirmation, ticket transcript, or written agreement. Any request outside the original scope may be treated as additional paid work.

4.2 Delivery Method

Delivery may occur by download link, email, Discord, repository access, dashboard access, or any electronic method we choose.

4.3 Client Cooperation

You agree to provide accurate information and timely cooperation (e.g., requirements, credentials, access, assets). Delays or failures by you may delay delivery and do not create any refund entitlement.

4.4 Completion / Acceptance

A service is considered delivered once:

  • the Deliverables are provided electronically, or
  • access is granted, or
  • the work is completed according to the agreed scope.

Pricing, Payments, and Final Sale

5.1 All Sales Final — No Refunds

All payments are final. No refunds, returns, or exchanges are provided.

This policy applies (without limitation) to:

  • Digital Goods
  • Custom Work
  • Setup/configuration services
  • Consulting/support time
  • Subscriptions/renewals (if applicable)

You acknowledge that Digital Goods and Custom Work may be delivered or started immediately after purchase and therefore cannot be "returned."

5.2 Payment Processing Fees

You are responsible for any transaction fees, currency conversion fees, intermediary fees, or bank charges.

5.3 Failed / Reversed Payments

If a payment is reversed, disputed, or charged back after delivery or after work has started, we reserve the right to suspend access, revoke licenses (where permitted), terminate support, and pursue recovery of associated costs.

Chargebacks & Payment Disputes

Chargebacks and disputes create direct losses and administrative fees. If you submit a chargeback or dispute:

  • We may immediately suspend delivery, support, updates, and access.
  • We may provide evidence of delivery and communications to the payment processor.
  • Where legally permitted, you agree to reimburse reasonable costs incurred due to the dispute (including processing fees and administrative time).

Client Responsibility & Proper Use

You are solely responsible for your use of the Services and Deliverables.

You agree that you are fully responsible for:

  • your compliance with all laws, rules, and regulations applicable in your jurisdiction;
  • your compliance with third-party platform policies (e.g., hosting providers, marketplaces, game platforms, communication platforms, etc.);
  • securing your accounts, servers, credentials, and systems;
  • maintaining backups and safe deployment practices.

We are not responsible for any bans, suspensions, restrictions, blocks, takedowns, penalties, or enforcement actions taken by third parties as a result of your use of the Deliverables.

Prohibited Use

You must not use the Services or Deliverables to:

  • violate any law or regulation;
  • infringe intellectual property or privacy rights;
  • distribute malicious code, exploit systems, or engage in unauthorized access;
  • harass, scam, defraud, or harm others;
  • use the Services in a way that creates unacceptable risk or liability for Oblivity.

We may refuse service or terminate access if we reasonably believe prohibited use is occurring.

Intellectual Property, License, and Restrictions

Unless explicitly agreed in writing:

9.1 Ownership

Oblivity retains ownership of:

  • our pre-existing code, frameworks, templates, methods, designs, internal tools, and know-how;
  • any non-client specific components included in the Deliverables.

9.2 License to Client

You receive a limited, non-exclusive, non-transferable, revocable license to use the Deliverables for your internal/personal/business use consistent with the order's scope.

9.3 No Redistribution

You may not resell, redistribute, publish, share, leak, or sublicense the Deliverables (or any portion) without our prior written permission.

9.4 Security of Deliverables

You are responsible for preventing unauthorized access to your Deliverables (including private repos, files, credentials, or downloads). Compromised access does not create any refund entitlement.

Support & Service Availability

10.1 Support Times May Vary

Support availability and response times may vary due to workload, time zones, holidays, maintenance, and complexity. We do not guarantee 24/7 support unless explicitly agreed in writing.

10.2 Third-Party Changes

You acknowledge that third-party updates, platform changes, API changes, server/environment changes, or provider outages may affect functionality. Such issues may be outside our control.

Disclaimer of Warranties (As-Is / As-Available)

To the maximum extent permitted by law, the Services and Deliverables are provided "AS IS" and "AS AVAILABLE." We make no warranties, express or implied, including (without limitation):

  • that the Services will be uninterrupted, error-free, or always compatible with your environment;
  • that the Services will meet every expectation not explicitly written in the scope;
  • that all security vulnerabilities can be prevented or predicted.

Liability Disclaimer & Limitation of Liability

To the maximum extent permitted by law, Oblivity shall not be liable for any loss or damage arising from your use of the Services or Deliverables, including (without limitation):

  • system damage, instability, or downtime;
  • data loss, corruption, or backup failures;
  • performance issues;
  • vulnerabilities discovered after delivery;
  • financial loss, lost revenue, lost profits, reputational harm, or business interruption;
  • actions taken by third parties (bans, restrictions, penalties).

Where liability cannot be excluded, our total aggregate liability for any claim related to a specific order shall be limited to the amount you paid for that order.

Indemnification

You agree to defend, indemnify, and hold harmless Oblivity from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • your use or misuse of the Deliverables;
  • your violation of these Terms;
  • your violation of any law or third-party rights/policies.

Right to Modify These Terms

We reserve the right to modify, update, or replace these Terms at any time. Updates become effective once posted on our website or otherwise made available. We may modify these Terms without further notification. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

Termination

We may suspend or terminate access to Services and/or support if:

  • you violate these Terms;
  • you engage in abusive behavior toward staff;
  • you commit fraud, chargeback abuse, or unlawful use.

Termination does not create any refund entitlement.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with any written order details (invoice, product description, ticket transcript, or signed agreement), constitute the entire agreement between you and Oblivity regarding the Services and supersede prior discussions.
